Notice of Complete Application and Public Meeting for Official Plan Amendment and Zoning By-law Amendment, File Number D09-24-02 and D14-24-06

Take notice that the City of Kenora Planning Advisory Committee (PAC), who hears applications and provides recommendations to Council, will hold a regular meeting on September 18, 2024, at 6 p.m. As part of this meeting, PAC will hold an open house to consider a recommendation on a proposed Official Plan Amendment as it pertains to the City of Kenora Official Plan 2015 (By-law No. 75-2015) and a proposed Zoning By-law Amendment as it pertains to the City of Kenora Zoning By-law 101-2015, as described below and shown on the map.

Take notice that Council of the Corporation of the City of Kenora will hold a Statutory Public Meeting to consider the proposed application.
Statutory public meeting
When: Tuesday, September 10, 2024 at 12:00 p.m.
Location: Council Chambers, City Hall, 1 Main Street South, Kenora, ON
Members of the public interested in attending the public meeting, may attend in person, or watch the livestream meeting on our Agenda and Minutes page. For access to speak at the public meeting virtually, please contact the City Clerk. If you attend in person, there is no need to register to attend.
The Council of the Corporation of the City of Kenora will consider a decision regarding the application during their meeting on Tuesday, October 15, at 5:00 p.m. Access to that livestream meeting may be viewed on our Agenda and Minutes page.

Be advised that the Corporation of the City of Kenora considered the Application for an Amendment to the Official Plan and Amendment to the Zoning By-law to be completed on August 27, 2024.
Purpose and effect
The purpose and effect of the Official Plan Amendment is to change the designation of the east part of the subject property from ‘RU’ Rural Area designation to ‘CD’ Commercial Development Area designation to permit future commercial uses. The application also proposes to add mixed-use developments with non-residential uses on the ground floor and residential uses located above as a permitted use under Section 4.4.1 to permit mixed-use developments. The purpose and effect of the Zoning By-law Amendment is to change the zoning of the subject property from ‘RU’ Rural zone and ‘EP’ Environmental Protection underlay to a site specific ‘LC[63]’ Local Commercial Zone and ‘EP’ Environmental Protection underlay. The site-specific zone is to permit a multi-storey, mixed-use development with commercial uses on the ground floor and residential uses above, a maximum building height of 15 metres, and employee and visitor parking spaces in the required front yard.
Public meeting
Input on the proposed application is encouraged. You can provide input by speaking at the PAC open house and/or Statutory Public Meeting. You may also provide your comments in writing as follows:
Submit comments in writing
Persons wishing to provide comments for consideration at the Statutory Public Meeting may submit such comments in writing no later than Wednesday, October 2, 2024, quoting File Number: D09-24-02/D14-24-06 by email to Planning, or by regular mail to Mrs. Tara Vader, Associate Planner, 60 Fourteenth Street North, 2nd Floor, Kenora, ON P9N 3X2.
Failure to make oral or written submission
If a person or public body would otherwise have an ability to appeal the decision of The Council of the Corporation of the City of Kenora to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to The Corporation of the City of Kenora before the proposed Official Plan Amendment is adopted or the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to The Corporation of the City of Kenora before the proposed Official Plan Amendment is adopted or by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
