Notice of Decision

In accordance with Sections 17 and 28 of the Planning Act, R.S.O. 1990, as amended, a decision was made by the Council of the Corporation of the City of Kenora to designate three Community Improvement Project Areas, amend three existing Community Improvement Plans, and adopt an Official Plan Amendment. The date of decision and last date of appeal are noted below.

The By-laws adopted by Council are as follows:

  • By-law 27-2017 to adopt a Community Improvement Project Area for Keewatin
  • By-law 28-2017 to adopt the Keewatin CIP, 2017
  • By-law 29-2017 to adopt a Community Improvement Project Area for Harbourtown Centre
  • By-law 30-2017 to adopt the Harbourtown Centre CIP, 2017
  • By-law 31-2017 to adopt a Community Improvement Project Area for the Former Mill Site
  • By-law 32-2017 to adopt the Former Mill Site CIP, 2017
  • By-law 33-2017 to adopt Official Plan Amendment No. 3

Purpose and Effect

A Community Improvement Plan (CIP) is a tool that allows the City of Kenora to encourage and stimulate economic development and community revitalization through financial incentives. The City of Kenora currently has three CIPs in effect: the Keewatin CIP, the Harbourtown Centre CIP, and the Former Mill Site CIP. The existing CIPs were amended as follows:

  • Expanded the landscaping grant in the Keewatin CIP;
  • Added housing grants and a tax incentive grant to the Harbourtown Centre CIP;
  • Added housing grants to the Former Mill Site CIP;
  • Expanded the Former Mill Site CIP Project Area to include the former clarifier site; and
  • In all CIPs, recognition of new legislated policy and City directives which have come into force since the existing CIPs were approved.

In addition, the Official Plan was amended as follows:

  • Added a new Schedule “C” delineating the boundaries of the three CIPs
  • Revised Section 8.2 to indicate that the Keewatin CIP is in effect; and
  • Revised Section 10.0 to recognize the new Schedule “C”.

When and How to File an Appeal

Any appeal to the Ontario Municipal Board must be filed with the Approval Authority (City of Kenora) to the attention of the Clerk, no later than 20 days from the date of this notice as shown above as the Last Date of Appeal.

The appeal should be filed at the address shown below, be in accordance with the OMB guidelines (www.omb.gov.on.ca), and it must:

  1. Set out the specific part of the proposed By-laws to which the appeal applies;
  2. Set out the reasons for the appeal; and
  3. Be accompanied by the fee prescribed under the Ontario Municipal Board Act in the amount of $300.00 payable by certified cheque or money order to the Minister of Finance, Province of Ontario.

Who Can File an Appeal

Only individuals, corporations or public bodies may appeal a decision of the Approval Authority to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the By-laws were adopted, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

When the Decision is Final

The decision of the Approval Authority is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

A copy of the amended CIPs will be available for public review beginning April 1st, 2017 during regular office hours (8:30 a.m. to 4:30 p.m.) at the Operations Centre at 60 Fourteenth Street North, 2nd Floor, and online at the City’s website www.kenora.ca.
