Purpose and Effect:
The purpose and effect of the Official Plan Amendment is to:
• Change the Official Plan Designation from “Residential development Area” to “Rural Area”. The proposed site specific amendment to the zoning by-law would then be consistent with the Official Plan Designation.

The purpose and effect of the Zoning By-law Amendment is to:
• Add site specific permitted uses under the RU zone provisions, including campground and resort. This will enable use of the property as a small farm with a total of 12 campsites, offering people travelling with horses short term accommodation, and the potential for summer & year-round cabins in a future phase of development.

DESCRIPTION OF LANDS: As all lands within the City of Kenora are affected by the proposed City-initiated amendments to the Official Plan (By-law No. 75-2015) and Zoning By-law (By-law No. 101-2015), no key map is provided.

THE PURPOSE AND EFFECT OF THE OFFICIAL PLAN AMENDMENT (BY-LAW NO. 84-2019) IS TO:
• Amend Section 3.20 Public Uses to permit a public use, including but not limited to an institutional use, housing, and supportive housing, but excluding a correctional facility, in the following land use designations, without the need for an Official Plan Amendment, and with consideration for the policies in the Land Use Compatibility Section of the Official Plan: Established Area; Residential Development Area; Harbourtown Centre; and Commercial Development Area.

THE PURPOSE AND EFFECT OF THE ZONING BY-LAW AMENDMENT (BY-LAW NO. 85-2019):
• Amend Section 2 Definitions to add a new definition for “Public Use”;
• Amend Section 2 Definitions by replacing “Public Authority” with “Public Agency”, and by amending the definition;
• Amend the definitions of “Conservation” and “Sewage Facility” in Section 2 Definitions to replace references to “public authority” with “public agency”; and
• Amend Section 3.34.5 Public Uses to add a new provision to allow a public use, including but not limited to an institutional use, housing, and supportive housing, but excluding a correctional facility, to the following zones: Residential – First Density Zone (R1); Residential – Second Density Zone (R2); Residential – Third Density Zone (R3); Local Commercial Zone (LC); General Commercial Zone (GC); Highway Commercial Zone (HC); and Institutional Zone (I).

EFFECT OF PUBLIC SUBMISSIONS ON THIS DECISION: No written submissions were received, however, the City gave consideration to those comments and questions that were raised at the public meeting, noting the existing housing shortage in Kenora, evidenced through the current waiting lists for social housing units, as well as additional demand for other housing throughout the housing continuum, and that the results of the 2018 Election Survey, showed that 70% of respondents said affordable housing is what Council should focus on over the next four years.

ANY PERSON OR PUBLIC BODY MAY APPEAL THIS DECISION to the Local Planning Appeal Tribunal by filing with Heather Pihulak, City Clerk, City of Kenora, 1 Main Street South, Kenora, ON, P9N 3X2, no later than 4:30 p.m. on Tuesday, June 18th, 2019. The notice of appeal must:
i) Set out the reasons for the appeal. The reasons for the appeal must include an explanation of how the proposed Official Plan Amendment and/or Zoning By-law Amendment: are inconsistent with a provincial policy statement issued under subsection 3(1) of the Planning Act; fail to conform with or conflict with a provincial plan; or fail to conform with the City of Kenora Official Plan (November 5, 2015);
ii) Set out the specific part or parts of the proposed Official Plan Amendment and / or Zoning By-law Amendment to which the appeal applies; and

The proposed Official Plan Amendment (By-law No. 84-2019) is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of the Council of the City of Kenora is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. The purpose of this notice is to notify the public that the City will be closing the unopened road allowance, located adjacent to 400 and 338 Fourth Street North, and declaring a portion of the lands surplus (refer to sketch). Council will give consideration to the by-law during the May 14th, 2019 Committee of a Whole meeting, which commences at 9 am. A decision will be made on May 21st, 2019 during the regular Council meeting.

The subject land is approximately 0.099 ha in size, generally 21 m in width and 46 m in length. The land will be described on a reference plan, consolidated on title, and merged with abutting land for development in accordance with the R2-Residential Second Density Zone within the Zoning By-law No. 101-2015.

Notice of Decision for a Zoning By-law Amendment To Comprehensive Zoning By-Law No. 101-2015

Notice is hereby given, that the Council of the City of Kenora passed By-Law No. 54 – 2019 at a meeting on Tuesday, April 16th, 2019, thereby giving approval to a Zoning By-law Amendment. Public notice of the Application was given in reference to Planning File No. D14-19-03.

Location of Property: 661 Ninth Street North, being a proposed lot with 62 metres of frontage on Ninth Street North, west of the Kenora Armoury and north of the Evergreen Community Club. The lands are technically part of the property known as the “former mill lands”. Refer to the location sketch below.

Purpose and Effect: To change zoning of property as identified from Residential – Second Density and hold for development plan (R2-h) to Residential – Third Density (R3); to add a definition for Supportive Housing to Section 2 of the By-law, to create parking provisions, and to allow Supportive Housing as a permitted use, site specific to property described as being 0.6 hectares located at the west end of the former mill site, having 62 metres of frontage on Ninth Street North:

Supportive Housing
A residential use building containing rooming units or a combination of rooming and dwelling units, providing residence to any persons requiring supports to live, and support services on-site which may or may not include collective dining facilities, laundry facilities, counselling, educational services, and transportation. This does not include Retirement Homes, Continuum Care Facilities, Correctional Facilities, or Emergency Shelters,

To amend Table 4 of Section 3.23, to include Parking Requirements for Supportive Housing at the rate of 0.25 per rooming unit or 4 beds plus 1 per 100 m² of gross floor area used for medical, health or personal services.

Council gave consideration to the public submissions, the development is supported by the Provincial Policy Statement and the Official Plan.

Other Planning Applications Relevant to the Subject Location: the property will also be the subject of an application for consent to sever and site plan approval.

The Last Date for Filing a Notice of Appeal is Tuesday, May 7th, 2019.

The Corporation of the City of Kenora has received an application from an abutting land owner to purchase City unopened road allowance for lot addition to 400 Fourth Street North. The subject land is located adjacent to 400 and 338 Fourth Street North. Refer to the sketch below for an illustration.

The purpose of this notice is to notify the public of the by-law that will be under consideration to declare lands available for disposal. Council will give consideration to the by-law during the April 9th, 2019 Committee of a Whole meeting. A decision will be made on April 16th, 2019 during the regular Council meeting.

The subject land is approximately 0.099 ha in size, generally 21 m in width and 46 m in length. Toward the lot addition, the property will be described on a reference plan, consolidated on title, and merged. The land is vacant and would be developed in accordance with the provisions of the R2-Residential Second Density zone within the Zoning By-law No. 101-2015.

Notice is hereby given, that the Council of the City of Kenora passed By-Law No. 41 – 2019 at a meeting on Tuesday, March 19th, 2019, thereby giving approval to a Zoning By-law Amendment. Public notice of the Application was given in reference to Planning File No. D14-19-02.

Location of Property: Area A known as the ‘Anchor Inn’ at 543 Lakeview Drive, Area B at 49 Nash Drive, and Area C at the southside of Nash Street. Refer to the location sketch on the reverse side of this notice (Page 2).

Purpose and Effect: To change zoning of property as identified from Highway Commercial (HC) to Tourist Recreational (TR-42) to allow for development of uses permitted within the TR zone, including a Resort;

Area ‘A’, to reduce the eastside yard setback to allow a narrowing from 4.5 m to 1.6 m, reduce the westside yard setback to 2.4 m, reduce the front yard setback to 6 m, reduce the rear yard to 4.5 m, increase building height to enable a variable terraced design to 15 m;

Area ‘C’, to allow for a two story Club House and Administration Office, not more than 7 m in height, to reduce the setback from water to 6 m, to reduce the rear setback to 4.5 m;

To increase the lot coverage for the overall development to 44%.

Council gave consideration to the public submissions, noting that the development would be a great improvement for the property and that future applications for Condominium and Site Plan will be brought forward.

The Last Date for Filing a Notice of Appeal is Wednesday, April 10th, 2019.
