The Kenora District Services Board (KDSB) in partnership with the City of Kenora are excited to be planning a new Mixed Market Supported Senior’s Housing Development in the City of Kenora on lands locally known as the “Howard Property” located at the corner of Seventh Avenue South and Eighth Street South. Please refer to the sketch below for an illustration.

The purpose of this notice is to inform the public of the by-law that will be under consideration to declare the lands available for disposal by the Corporation of the City of Kenora to KDSB at the Committee of the Whole meeting on October 13, 2020 and placed on the Council Agenda for decision on October 20, 2020.

It is anticipated that the project will include 54 units consisting of a mix of both 1 and 2-bedroom configurations with a focus on accessibility and aging-at-home supports. The new building will include dedicated space for health and senior’s service providers to ensure that residents are supported as they age-in-place. The building will be a mixed market model, with units being made available to seniors of all income levels. KDSB has committed to forming a working group of community partners, including Health and Supportive Senior Service Providers, Senior Citizen Interest Groups, and local seniors, to aid in the project’s visioning.

LOCATION OF THE PROPERTY
The subject lands are a 25.49 hectare parcel generally bordered by Veteran’s Drive to the west, Ninth Street North to the north, Ninth Avenue North to the east, and Fifth Street North to the south. The site is predominantly surrounded by areas designated as Established Area under the City of Kenora Official Plan, being a mix of residential, institutional, recreational and religious uses and small commercial/industrial uses. The CPR corridor is located further to the south, as is the downtown area known as the Harbourtown Centre. The majority of the land immediately to the west of the site (i.e. east of Veteran’s Drive) remains undeveloped.

DESCRIPTION OF PROPOSAL
The proposed Plan of Subdivision is to divide ownership into fifteen (15) proposed lots, creating twelve (12) ML- Light Industrial lots and three (3) R3- Residential – Third Density lots.

Access to the Subject Lands is via Ninth Street North, Ninth Avenue North and Fifth Street North. The proposed internal road system will be private road at 20.0 m wide.

The subject lands will be serviced by municipal sewer and water.

VIRTUAL PUBLIC MEETING: Although in-person Committee meetings have been cancelled, there are several ways in which the general public can provide input on the proposed Plan of Subdivision as follows:

NOTES REGARDING YOUR RIGHTS

i. If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submissions to the Secretary-Treasurer of the Planning Advisory Committee in respect of the proposed Plan of Subdivision before the approval authority gives or refuses to give approval to the proposed Plan of Subdivision, the person or public body is not entitled to appeal the decision of the Planning Advisory Committee to the Local Planning Appeal Tribunal.

ii. If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submissions the Secretary-Treasurer of the Planning Advisory Committee in respect of the proposed Plan of Subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

iii. LOCATION OF THE PROPERTY
The subject lands are located in a mixed-use neighbourhood which was part of a small highway commercial and residential area in the former Town of Jaffray Melick. The subject lands abut Laurenson Creek, a Provincially Significant Wetland to the south, and light industrial use lands to the east. There is a mix of residential and light industrial/highway commercial uses on the north side, along Railway Street. The abutting property, to the west, is a single detached dwelling and there are single detached and multi residential dwellings in the immediate area. The subject lands are located approx. 300 metres south of the Canadian Pacific Railway. A Key Map is provided below.

DESCRIPTION OF PROPOSAL
The Draft Plan of Condominium (known as Laurenson Landing) will be a phased development consisting of seventy-three (73) units in three (3) phases. The first phase would see the development of fourteen (14) single storey, multiple attached dwelling and fifteen (15) two storey stacked multiple attached dwellings. The second phase would consist of fifteen (15) single storey multiple attached dwelling units and sixteen (16) two storey, stacked dwelling units. The third phase proposes an additional thirteen (13) two storey multiple attached dwelling units. Common elements include driveways and rear yard amenity space.

The Draft Plan of Condominium application is to divide the ownership into the 73 proposed units.

Access to the Subject Lands is via Railway Street, one of Kenora’s main arteries. The proposed internal road system will be a crescent and one road; the road will be 8 m in width.

TAKE NOTICE that the Council of the City of Kenora passed By-law No. 171-2019 at a meeting on Tuesday, November 19th, 2019, under Section 17 of the Planning Act, RSO 1990, c. P.13, as amended.

AND TAKE NOTICE that the Council of the City of Kenora passed By-law No. 172-2019 at a meeting on Tuesday, November 19th, 2019, under Section 34 of the Planning Act, RSO 1990, c. P.13, as amended.

DESCRIPTION OF LANDS: The subject lands are municipally known as the “Former Abitibi Mill site”, civic address 661 Ninth Street North, and described as unopened roads, lots and blocks on historical plans of survey, being PINs # 42170-0258 and 42170-0244. A Key Map is provided below.

THE PURPOSE AND EFFECT OF THE OFFICIAL PLAN AMENDMENT (BY-LAW NO. 171-2019) IS TO:
• Redesignate the subject lands, from Future Development Overlay, Industrial Development Area, Railyard, and Residential Development
Area to Commercial Development Area, Industrial Development Area, and Residential Development Area.
• The effect of the Official Plan Amendment is to enable commercial, industrial and residential development to occur on the subject lands.

THE PURPOSE AND EFFECT OF THE ZONING BY-LAW AMENDMENT (BY-LAW NO. 172-2019):
• Rezone the subject lands from Future Development (FD), Heavy Industrial (MH), and Residential Second Density, Holding (R2[h]) to General
Commercial, Exception (GC[50]), Light Industrial (ML), Light Industrial, Exception (ML[46]), and Residential Third Density, Holding (R3[h]).
• The effect of the Zoning By-law Amendment is to rezone lands to conform with the proposed Official Plan Amendment to enable
commercial, light industrial uses and residential development to occur on the subject lands.
• The effect of the General Commercial, Exception Zone (GC[50]) is to require a minimum front yard setback of 10 m and a minimum exterior
side yard setback of 10 m. These requirements will ensure that appropriate setbacks and sightlines are maintained along Veteran’s Drive
and Ninth Street North, as the General Commercial Zone permits 0 m setbacks.
• The effect of the Light Industrial, Exception Zone (ML[46]) is to allow a reduced front yard requirement from 18 m to 1.6 m and to allow
reduced exterior side yard (south) setbacks from 6 m to 1.7 m and (north) 6 m to 2.4. These reductions are required given the existing
buildings on site as a result of a concurrent Consent Application for the subject lands.
• The effect of the Residential Third Density, Holding (R3[h]) is to place a holding on the subject lands until a Record of Site Condition is
submitted and approved prior to any residential development occurring on the subject lands.

EFFECT OF PUBLIC SUBMISSIONS ON THIS DECISION: The City heard comments and questions that were raised at the public meeting, fourteen (14) written submissions and a petition was also received. Comments expressed support for the proposed redesignation and rezoning, and other comments expressed concern over the potential future development of a casino on the subject lands.

ANY PERSON OR PUBLIC BODY MAY APPEAL THIS DECISION to the Local Planning Appeal Tribunal by filing with Heather Pihulak, City Clerk, City of Kenora, 1 Main Street South, Kenora, ON, P9N 3X2, no later than 4:30 p.m. on Wednesday, December 18th, 2019. The notice of appeal must:

i) Set out the reasons for the appeal, and set out the specific part or parts of the proposed Official Plan Amendment and/or Zoning By-law Amendment to which the appeal applies; and
ii) Be accompanied by the fee prescribed under the Local Planning Appeal Tribunal Act, 2017 in the amount of $300.00, payable by cheque to the Minister of Finance, Province of Ontario.

The proposed Official Plan Amendment (By-law No. 171-2019) is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of the Council of the City of Kenora is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body
made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.

The subject lands are also the subject of an application under the Planning Act for a Consent, File No. D10-19-14, which will be considered for
approval by the City of Kenora Planning Advisory Committee on November 26, 2019.

The purpose and effect of the Official Plan Amendment is to:
• Redesignate the subject lands, from Future Development Overlay, Industrial Development Area, Railyard, and Residential Development Area to Commercial Development Area, Industrial Development Area, and Residential Development Area.
• The effect of the Official Plan Amendment is to enable commercial, industrial and residential development to occur on the subject lands.

The purpose and effect of the Zoning By-law Amendment is to:
• Rezone the subject lands from Future Development (FD), Heavy Industrial (MH), Residential Second Density, Holding (R2[h]) to General Commercial (GC), Light Industrial (ML), Light Industrial, Exception (ML[46]), and Residential Third Density, Holding (R3[h]).
• The effect of the Zoning By-law Amendment is to rezone lands to conform with the proposed Official Plan Amendment to enable commercial, light industrial uses and residential development to occur on the subject lands.
• The effect of the Light Industrial, Exception Zone (ML[46]) is to allow a reduced front yard requirement from 18 m to 1.6 m and to allow reduced exterior side yard (south) setbacks from 6 m to 1.7 m and (north) 6 m to 2.4. These reductions are required given the existing buildings on site as a result of a concurrent Consent Application for the subject lands.
• The effect of the Residential Third Density, Holding (R3[h]) is to place a holding on the subject lands until a Record of Site Condition is submitted and approved prior to any residential development occurring on the subject lands.

Description of the Lands: The subject lands are municipally known as the “Former Abitibi Mill site”, civic address 331 9th Street North, and described as unopened roads, lots and blocks on historical plans of survey, being PIN # 42170-0256. A Key Map is provided below.

Public Meetings: Input on the proposed amendment is encouraged. You can provide input by speaking at the PAC and/or Statutory Public Meeting, and you are not required to register in advance to speak. Notice is hereby given, that the Council of the City of Kenora passed By-Law No. 124 – 2019 at a meeting on Tuesday, August 13th, 2019, under Section 34 of the Planning Act, RSO 1990, c. P.13, as amended; thereby giving approval to a Zoning By-law Amendment. Public notice of the Application was given in reference to Planning File No. D14-19-08.

Location of Property: 915 Ottawa Street, PLAN 18 BLK 49 LOT 12; Townsite of Keewatin. Refer to the location sketch below.

Purpose and Effect: To change zoning of property as identified from Institutional (I) to Residential Density 3 – R3[45] to allow an existing building to apply for a change of use permit for an apartment dwelling containing six units, having interior and exterior access; with legal non-complying building setbacks (4.3 m front yard, 0.6 m interior side yard, 8 m rear yard), a total of 10 parking spaces on site, and 7 parking spaces having reduced lengths of 5.36 m.
